1. Trading involves substantial risk

Trading futures, foreign exchange, options, equities, and digital assets is highly speculative and involves a substantial risk of loss. You can lose some or all of the capital you commit, and in leveraged markets you can lose more than your initial deposit. Trading is not suitable for every investor. Only commit capital you can afford to lose without affecting your standard of living.

2. NexusATS is software, not advice

NexusATS is a rule-based trading strategy that runs in NinjaTrader 8 on your computer, against your brokerage account, using parameters and risk settings you control. NexusATS does not provide personalized financial, investment, tax, or legal advice, and is not registered as an investment adviser, commodity trading adviser, broker-dealer, or fund manager with any regulator (including the U.S. SEC, U.S. CFTC, NFA, UK FCA, EU ESMA, Canadian CIRO, ASIC, or equivalent). Before using the Software with real money, consult an independent, appropriately qualified professional.

Backtests typically assume idealized fills, omit broker commissions, swaps and spreads, and use only the periods of historical data they were measured against. Live results will differ — sometimes substantially.

4. Automated-trading specific risks

Automated strategies depend on software, hardware, internet connectivity, broker APIs, exchange data feeds, and third-party platforms (such as NinjaTrader). Any of these can fail or behave unexpectedly. Risks include, without limitation: software bugs, logic errors, mis-configuration, parameter mistakes, runaway behavior, latency, slippage, partial fills, gaps and limit-up/down moves, off-hours trading, exchange halts, broker rejections, data-feed corruption, API outages, network drops, hardware failure, power failure, OS updates, and platform updates. You agree to actively supervise the Software while it is enabled and to maintain appropriate broker-side and account-side controls, including stop-loss orders, daily loss limits, and position-size caps.

5. Personal responsibility

You alone choose whether to run the Software, when to run it, which markets and instruments to use it on, what parameters to set, how much capital to allocate, and whether to intervene manually. You are responsible for the outcome of every trade placed under your credentials. Funds you commit to automated trading should be risk capital — money the loss of which would not materially harm your financial security.

6. No guarantee of execution, no guarantee of result

No representation is made that NexusATS will be profitable, will avoid losses, will perform during a specific market environment, or will execute any trade at any specific price or time. Severe market conditions, including black-swan events, flash crashes, exchange halts and liquidity shocks, can cause executions far from the indicated price or no execution at all.

7. Suitability

Before using NexusATS, consider your objectives, financial situation, level of experience, and risk tolerance. We do not assess your individual circumstances. If automated futures trading is not suitable for you, do not use the Software.
