1. No guarantee of profit or income

NexusATS does not promise, guarantee, or imply any specific financial result, return, profit, income, win rate, drawdown, or "passive income" outcome. We do not represent that you will earn money, recover your subscription fee, or reach any particular performance level. Trading futures and other leveraged products involves a substantial risk of loss, and the majority of retail traders lose money.

2. Hypothetical, illustrative, and backtested figures

All numerical examples shown on this website, in the dashboard, in screenshots, equity curves, marketing materials, social media posts, and demonstration videos — including any P&L values, win rates, average-trade figures, and trade counts — are illustrative or hypothetical unless explicitly labelled "Live, audited, third-party verified results". They are based on backtests, simulated runs, or design-time placeholders.

Backtests have well-known limitations: they are constructed with the benefit of hindsight, assume idealized fills, often understate or omit commissions, swap fees, slippage and partial fills, and reflect only the historical period and instrument tested. Real-time, live trading invariably differs. The official CFTC Rule 4.41 disclosure in our Risk Disclaimer applies to all such figures.

3. Why individual results vary

Many factors determine your real-world results, including but not limited to: the broker you use, broker latency and execution quality, commission and spread structures, your account size and leverage, your chosen instruments and contract sizes, the parameter values you configure, your risk and stop settings, market conditions during the period you trade, news and macro events, your hardware, internet connection, and your decisions to enable, pause, override, or close positions manually.

4. Testimonials

Any testimonials we display are individual experiences shared by users and are not representative of typical results. Most users do not achieve the results described in any testimonial. Where we identify a user, we do so with their consent and indicate whether compensation or product was provided in connection with the testimonial, in accordance with the FTC Endorsement Guides (16 C.F.R. Part 255), the UK ASA / CAP Code, and equivalent rules.

5. No "loss of expected profit" claim

To the maximum extent permitted by law, you agree that you will not seek damages from NexusATS for "loss of expected profits", "missed gains", drawdowns experienced while running the Software, or any consecutive losing sequence. Statutory consumer rights that cannot be excluded remain in effect.

Statements about future strategy behavior, roadmap features, or expected updates are forward-looking and subject to change. Past performance — whether simulated or live — is not a reliable indicator of future results.
