Billing, Subscription & Refund Policy

Provider: NexusATS — sole-proprietor business established in Canada. Contact: [email protected] / [email protected]. Postal address provided on written request and disclosed to EU/UK consumers per Directive 2011/83/EU prior to contract conclusion.
1. Plans and prices
- Monthly Subscription: USD 59.99, billed every month, automatically renewing on the same day each month until cancelled.
- Lifetime License: USD 349.99, one-time payment, granting a license for the operational life of the NexusATS product offering as defined in §6 of the Terms of Service.
Prices are exclusive of applicable taxes. EU/UK VAT, Canadian GST/HST/QST, Australian GST, and other applicable taxes are calculated and displayed at checkout based on your billing country.
2. Payment processors and Merchant of Record
Card payments are sold and processed by Whop (Whop Inc.) acting as the Merchant of Record. For card purchases, Whop is the seller of record and is responsible for processing the payment, presenting the final price, and calculating, collecting, and remitting applicable sales tax and VAT/GST. Whop also performs payment fraud and risk screening on card transactions and may decline, hold, or reverse a transaction under its own policies; approvals and declines for card payments are determined by Whop and its acquiring partners. Card purchases are additionally subject to Whop's own terms of service and privacy policy.
Cryptocurrency payments are processed via our payment partner referenced inside our Discord checkout flow. NexusATS does not store raw card numbers; for card payments Whop (and its processors) is the controller for raw card data and operates under its own terms and PCI DSS obligations.
3. Pre-purchase disclosures (EU Consumer Rights Directive Art. 6 / UK CCR 2013)
At checkout, before you commit to pay, you will see: the name of the Software, the chosen plan, the total price including any taxes and recurring billing frequency, the next renewal date for subscriptions, the company providing the Software and a contact route, the digital-goods nature of the product, your statutory withdrawal rights and how they apply (see §5 below), and the cancellation route (see §7).
4. Authorization
By completing checkout you authorize NexusATS and its payment processors to charge the payment method you provide for the selected plan and any applicable taxes. For monthly plans you authorize recurring charges for the agreed amount on each billing date until you cancel. Renewal pricing for an existing subscription will not be increased except on at least 30 days' prior notice to your registered email, and you may cancel before the new price takes effect.
5. Refund policy — digital goods, with mandatory statutory rights preserved
NexusATS is digital content that begins delivery (license generation, software access, dashboard entitlement) immediately upon payment. As a general matter, all sales are final once delivery has begun and we do not issue voluntary refunds for change of mind. However:
- EU / EEA / UK consumers — Right of withdrawal. Under Article 16(m) of EU Directive 2011/83 (and equivalent UK regulations), you ordinarily have 14 days to withdraw from a distance contract for digital content. That right is lost where (a) performance has begun with your prior express consent, and (b) you acknowledge that you thereby lose the right of withdrawal. At checkout you may either (i) tick the box requesting immediate delivery and acknowledging that you waive the 14-day right of withdrawal once delivery begins, in which case no withdrawal refund is available, or (ii) decline that box, in which case digital delivery will not begin for 14 days and you may withdraw within that period for a full refund. If you do not see that option, contact [email protected] within 14 days of purchase.
- Quebec consumers. The Quebec Consumer Protection Act provides cancellation rights for certain distance contracts. We honour all rights that apply to your transaction under that Act. Contact [email protected] for a Quebec-consumer refund request.
- Australian, New Zealand and other consumers retain non-excludable statutory guarantees (e.g. Australian Consumer Law). If the Software is not of acceptable quality, materially fails to match its description, or fails to be fit for a disclosed purpose, you may be entitled to a remedy that we will not contractually exclude.
- Universal goodwill exceptions. Independently of statutory rights, we will issue a refund where: (i) duplicate charges occurred; (ii) the Software was not delivered or activation could not be completed despite reasonable troubleshooting; (iii) we determine in our reasonable discretion that a refund is appropriate; or (iv) law requires it.
Approved refunds are returned to the original payment method within 10 business days, subject to processor and bank timelines. Crypto refunds are issued in the same coin and network or, where impractical, in stablecoin equivalent at the contemporaneous market rate, less network fees.
6. Failed payments
If a recurring charge fails, we will attempt the charge again and notify you. After repeated failure, your subscription will be suspended and your license deactivated until payment is restored. We will not retroactively charge you for the period the license was suspended.
7. Cancellations
See the standalone Cancellation Policy. In summary: you can cancel a monthly subscription at any time from your account dashboard (or by emailing [email protected]) and your access continues to the end of the paid period. Cancellation is at least as easy as sign-up, consistent with the FTC Click-to-Cancel rule (effective 2026) and Restore Online Shoppers' Confidence Act (ROSCA).
8. Renewal reminders
For monthly subscriptions, we send a reminder email at least three (3) days before each renewal date showing the amount to be charged and a one-click cancellation link.
9. Chargebacks and disputes — how we respond
If you believe a charge is unauthorized or incorrect, please contact [email protected] first — most issues are resolved within one business day. If you open a dispute with your bank or card network for a transaction you authorized and received, we will respond to the dispute using neutral documentary evidence, which typically includes: checkout consent records (policy version, timestamp, IP address, user-agent), order details, license-key generation and activation logs, account sign-in records, software-download or update records, and any support correspondence. We do not threaten, harass, or "blacklist" customers who exercise dispute rights, and we do not report individuals to credit bureaus. Where a dispute resolves in our favor, the underlying license remains subject to suspension only if the charge ultimately remains unpaid.
10. Taxes
Prices exclude tax. Where required, VAT, GST, HST, QST, sales tax, or equivalent will be added at checkout based on your billing country. You are responsible for any local taxes not collected by us. Tax-inclusive invoices are available on request for EU/UK customers.
11. Currency
Prices are denominated in USD. If your card or wallet is in another currency, your provider's exchange rate and any cross-currency fees apply.
12. Promotional codes
Promo codes are valid only for their stated terms, are non-transferable, and may not be combined unless explicitly permitted. We may revoke promo codes obtained by fraud, error, or abuse.
